Social Media Submissions and User Generated Content
To communicate with its customers and consumers Pinar operates its own website and media channels, as well as pages and accounts on a number of third-party social media platforms and websites (e.g. Facebook and Instagram and others Social Media) (collectively the “Pinar Social Media Site(s)”). Pinar invites you to post comments, photographs, videos, and any other content on those media channels, websites, and platforms. All content you choose to post, on any Pinar Social Media Sites, or on any other social media page or site (a “Third Party Social Media Site(s)”), including but not limited to comments, photographs, and videos is referred to here as “User Generated Content” or “UGC.” Furthermore, the term “Submissions” here includes your UGC plus your social media handle and other materials related to your UGC.
For the good and valuable consideration of the potential further dissemination of your Submissions, you agree to be bound by these Terms and the License Grant below, with respect to your Submissions, under a variety of circumstances, including but not limited to:
- Accessing, browsing, posting to, uploading, providing a Submission to or using any Pinar Social Media Site(s).
- Posting content on a Third Party Social Media Site or Pinar Social Media Site using a Pinar hashtag or tagging Pinar.
- Any situation in which Pinar contacts you on a Third Party Social Media Site, and ask you directly (in response to or in the comments to a post, via direct message, or via an email address provided by you) and you agree to allow Pinar to use your Submissions in accordance and agreement with these Terms.
You hereby represent and warrant that:
- you are a legally competent adult,

If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of Pinar to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Pinar in writing. What Types of Information Does Pinar Collect from Me?
Pinar gathers two basic types of information through the Site: “Personally Identifiable Information” (or “PII“) and “Non-Personally Identifiable Information” (or “Non-PII“). Personally Identifiable Information is information that identifies you as an individual, or relates to an identifiable person, including: name, postal address, telephone number, email address, and credit or debit card number. Personally Identifiable Information (PII)

Non-Personally Identifiable Information

Server Log Files
Your Internet Protocol (IP) address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider (ISP). This number is identified and logged automatically in our server log files whenever you visit the Site, along with the time(s) of your visit(s) and the page(s) that you visited. We and our service providers use IP addresses for purposes such as calculating Site usage levels, helping diagnose problems with the Site’s servers, and administering the Site. Additionally, we may aggregate PII in a manner such that the end-product does not personally identify you or any other user of the Site, for example, by using PII to calculate the percentage of our users who have a particular telephone area code. Such aggregate information is considered Non-PII for purposes of this Policy.
How Does Pinar Use Information Collected from Me?

We may use PII about you in the following ways:
Fulfillment of Requests
Pinar may use PII about you to fulfill the purpose for which such PII was provided (e.g., to send newsletters to you or respond to your inquiries).
From time to time, in our sole discretion, we may use PII about you to send to you important information regarding the Site, changes to our terms, conditions, and policies or other administrative information. How Is Personally Identifiable Information Disclosed?
Third Party Service Providers.
We work with third parties who provide services including but not limited to data analysis, web hosting, managing our mailing lists, advertising, order fulfillment and other administrative purposes. We reserve the right to use and disclose PII about you to others:

- to enforce our Terms of Service;
- to protect our operations or those of any Affiliated Entities;
- to protect the rights, privacy, safety or property of dd’s, the Affiliated Entities, you or others; and
- to permit us to pursue available remedies or limit the damages that we may sustain.
Other Important Notices Regarding Our Privacy Practices
We seek to use reasonable organizational, technical, and administrative measures to help protect against the loss, misuse and alteration of the PII under our control. Unfortunately, no data transmission over the Internet or data storage system can be guaranteed to be 100% secure. As a result, although we strive to protect PII about you, we cannot ensure the security of any information you transmit to us through or in connection with the Site or that is stored by us. The Site is controlled and operated by Pinar from the United States and is not intended to subject Pinar or any Affiliated Entity to the laws or jurisdiction of any state, country or territory other than that of the United States. Your PII may be stored and processed in any country where we occupy service providers, and, by using the Site, you consent to the transfer of information to countries outside your country of residence, including the United States, which may have data protection rules that are different from those of your country.
